Definition of Tourism Legislation

Tourism legislation is the body of constitutional laws, statutory acts, executive regulations, and international treaties enacted by a sovereign state to govern, regulate, inspect, and license the operations of travel agencies, hotels, airlines, tourist guides, and protected areas.

Primary Statute: Tourism Act, 2035 (1978)

The Tourism Act, 2035 (1978) is the principal legislation governing the registration, licensing, operation, and cancellation of travel agencies, trekking agencies, and tourist guides in Nepal under the Ministry of Tourism.

Licensing Requirements for Tourist Guides in Nepal

1. Completion of the mandatory professional Tourist Guide Training Course conducted by NATHM.
2. Holding a bachelor’s degree from a recognized university.
3. Passing formal oral and written language proficiency and heritage examinations conducted by the Department of Tourism.

Meaning of Air Service Agreement (ASA)

An Air Service Agreement (ASA) is a formal bilateral or multilateral treaty between two sovereign nations governing commercial international air traffic rights: designated airlines, flight routes, frequencies, and capacities.

Warsaw and Montreal Conventions

International air carrier treaties establishing unified global rules on airline liability in international carriage: establishing mandatory carrier liability for passenger injury/death, flight delays, and lost baggage compensation.

Travel and Trekking Agency Regulations (Tourism Act, 2035)

1. Mandatory Prior Licensing: No person can operate a travel or trekking agency without obtaining a formal operating license from the Department of Tourism.
2. Security Deposit / Bank Guarantee: Depositing a mandatory statutory bank guarantee with the government to protect consumers against fraud or insolvency.

Need for a New Federal Tourism Act in Nepal

1. Obsolescence of Tourism Act, 2035:
   • Enacted nearly 50 years ago under the Panchayat system; completely silent on digital e-commerce, online travel aggregators, adventure tourism safety standards, and environmental climate risks.
2. Harmonization with Federal Constitution of 2015:
   • The 2015 Constitution grants concurrent powers to Federal, Provincial, and Local levels over tourism.
   • The new Act must clearly delineate: Federal level handles international civil aviation and mega-peaks; Provincial levels manage regional circuits; Local levels handle homestays and trail licensing.
3. Digital & Sustainable Mandates:
   • Mandatory registration of digital accommodation platforms (Airbnb) and stringent penalties for illegal trekking operators.

Innkeeper’s Liability and Hotel Jurisprudence

1. Strict Liability vs. Prudent Care:
   • Under common law, innkeepers historically bore strict liability for guest property loss.
   • Modern statutes limit hotel liability if the hotel provides in-room digital safes, displays statutory liability notices behind room doors, and operates front-desk safe deposit boxes.
2. Innkeeper’s Lien (Right of Detention):
   • The legal right of a hotel to detain a defaulting guest’s personal luggage and baggage as security until unpaid room and restaurant bills are fully settled.
